Family Law Attorneys · Lake Ridge, Virginia

For a federal family, the pension is often bigger than the house.

Lake Ridge is full of federal employees, and for many, the retirement is the largest thing they own. The catch is that each piece, the FERS pension, the Thrift Savings Plan, the survivor annuity, gets divided its own way, with its own paperwork. We get each one right, with the case heard in Prince William County. Reach us when you are ready.

A first call is plain and costs you nothing.

What I tell federal families about the pension.

A federal retirement is not one asset. It is three, and each one is divided, and lost, in its own way.
  • 1

Divide each piece on its own

The FERS pension, the Thrift Savings Plan, and the survivor annuity each follow different rules and need different paperwork. Treating them as one lump is how money quietly slips away.

  • 2

The pension needs the right order

A federal pension is split by a court order the Office of Personnel Management must accept. We draft it to their standard so it is honored, not bounced back years later.

  • 3

Do not forget the survivor annuity

If the employee spouse dies, a former spouse's share of the pension can end unless the survivor annuity was elected. There is a deadline, and we make sure it is met.

Questions People Actually Ask

Plain answers, about the retirement.

These come up most with Lake Ridge's federal families. If yours is not here, just ask.

Have a question about your retirement?Call 571.260.0999 or send us a message.
Which court hears a Lake Ridge divorce?

Lake Ridge is in Prince William County, so the divorce and property division go to the Prince William County Circuit Court at 9311 Lee Avenue in Manassas. Custody or support on their own start at the Juvenile and Domestic Relations District Court in the same complex.

How is a federal pension divided?

By a separate court order the federal agency must approve. The FERS or CSRS pension, the Thrift Savings Plan, and the survivor annuity are each divided in their own way, with their own paperwork. Getting that order written to the agency's rules is what makes the division stick.

What is the Thrift Savings Plan and how is it split?

The TSP is the federal version of a 401(k). The marital share is divided by a retirement benefits court order sent to the TSP, which then transfers the funds. Done correctly, the split moves without taxes or penalties.

Why does the survivor annuity matter?

Because without it, a former spouse's share of a federal pension can end when the employee dies. The survivor annuity keeps it flowing, but it has to be elected within a strict deadline, so we make sure it is handled on time.

How long does it take?

An agreed Lake Ridge divorce can finish in about one to three months once the separation period is met. Dividing the retirement adds its own paperwork, which we prepare in parallel so it does not slow the divorce down.
