What I tell Falmouth clients about support.

Support is not a reward or a punishment. It is a bridge, meant to carry a spouse from one life to the next as fairly as the facts allow.
  • 1

There is no formula for the final number

For support after the divorce, Virginia does not use a fixed calculation. The court weighs the length of the marriage, each spouse's income and needs, and what each gave up. We build the case around those factors.

  • 2

    Length of the marriage matters

A short marriage and a thirty-year one are treated very differently. After a long single-income marriage, support can run for many years or even be open-ended, and we set realistic expectations from the start.

  • 3

    Support can change or end

Most support ends if the receiving spouse remarries, and it can be cut off after a year of cohabitation in a marriage-like relationship. A real change in either spouse's finances can also justify a modification.

Questions People Actually Ask

Plain answers, about spousal support.

These are the questions Falmouth clients ask first. If yours is not here, just ask.

Have a question about support?Call 571.260.0999 or send us a message.
How is spousal support decided in Virginia?

There is no formula for support after the divorce. The court weighs a statutory list of factors, including the length of the marriage, each spouse's income, needs, and earning ability, and the standard of living during the marriage. We build the case around those factors.

How long does support last?

It depends on the marriage. Support can be temporary during the case, set for a defined number of years, or open-ended after a long marriage. The longer the marriage and the wider the income gap, the longer support tends to run.

Does support ever end?

Usually. Spousal support generally ends if the receiving spouse remarries or either spouse dies, and it can be terminated after the recipient cohabits in a marriage-like relationship for a year. A real change in finances can also justify a modification.

Can I get support during the divorce?

Yes. A court can order temporary, or pendente lite, support while the case is pending, so a lower-earning spouse is not left unable to manage. The temporary amount does not lock in the final award, but it keeps the household stable.

Where is a Falmouth divorce filed?

In the Stafford Circuit Court at 1300 Courthouse Road, Stafford, the 15th Judicial Circuit, with spousal support decided as part of the divorce. Support on its own can also be pursued in the Juvenile and Domestic Relations Court in the same Judicial Center.
